What Is Elder Abuse or Neglect?
The Adult Protective Services Act authorizes victims or their surviving family members to bring claims against nursing homes, skilled nursing facilities, assisted living, group homes and other similar facilities for abuse and neglect. Instances of abuse and neglect commonly includes:
Pressure injuries/wounds which may be indicative of staff’s failure to take preventative measures such as turning and repositioning every two hours.
Falls which may be indicative of staff’s failure to take preventative measures such as providing assistance to the bathroom or answering the call light timely.
Urinary tract infections which may be indicative of staff’s failure to take preventative measures such as providing appropriate hygiene and peri-care.
Choking events which may be indicative of staff’s failure to take preventative measures such as cutting food into small pieces or supervising mealtime.
If you suspect that your loved one is experiencing any of the forms of abuse listed above, get in touch with our nursing home abuse law firm today.
Every resident should have an appropriate care plan in place to met his or her needs. Staff should execute the care plan in all aspects and should communicate regularly with the resident’s physicians. Care plans should include sufficient prevention interventions to avoid serious problems like falls, wounds, infection, malnutrition, dehydration and choking. Changes of condition should be monitored, reported and treated timely.
Throughout litigation, we prove the facility’s failures and how they injured our client. We frequently find that the facility’s ownership and management has failed to allocate sufficient budget to provide the appropriate staff to care for its residents. Inadequate budgeting and staffing leads to problems like long wait times to answer call lights, delays in repositioning immobile residents, lack of help with daily activities, and poor communication with family and providers.
In some cases, abuse or neglect causes death in which case we bring a wrongful death claim on behalf of the surviving family. Statutory beneficiaries can recover damages for the impact of the loss of the love and companionship of their loved one.

What Our Clients Are Saying
I spoke with a couple attorneys from different law offices before finding Michael Erike. None of the attorneys I spoke with would answer my questions without paying upfront, but Michael did. He immediately took initiative and began working on our first call. He answered all of my questions and gave me confidence that the situation could be resolved. He was very communicative throughout the entire process. I highly recommend him and Bailey Law. I will definitely reach out to Michael if I have other situations arise.

I contacted Bailey Law Firm after my car accident last year. The Bailey Law team not only checked in on me during my recovery but made sure I got the best medical treatment. During the process, my attorney and the paralegals kept me in the loop and were always available for contact if I had a question or concern. I know that if I ever needed a personal injury attorney I would 100% use them again.
